The Sergeant First Class Heath Robinson Honoring our Promise to Address Comprehensive Toxics (PACT) Act expands VA health care and disability benefits for veterans from the Vietnam, Gulf War, and post 9/11 eras who were exposed to toxic substances. It adds more than 20 new presumptive conditions tied to burn pits and other environmental hazards and also broadens presumptive exposure areas for Agent Orange and radiation.
For most VA claims, a veteran must prove that a current disability is connected to military service, usually with medical and service records. With a presumptive condition, the law or VA regulations automatically treat the condition as service connected if the veteran meets specific service requirements, so the claim process is often faster and more favorable.
The PACT Act added numerous cancers and respiratory diseases as presumptive for veterans exposed to burn pits and other toxins, including any type of respiratory cancer, many gastrointestinal and head and neck cancers, and non-cancer conditions like asthma, chronic bronchitis, COPD, chronic sinusitis, and interstitial lung disease. It also added new presumptive conditions related to Agent Orange exposure, such as high blood pressure (hypertension) and monoclonal gammopathy of undetermined significance (MGUS).
Because of the PACT Act, many veterans who previously had claims denied for toxic exposure related conditions may now qualify under the new presumptions. Veterans who served in specified locations and time periods and who have one of the listed presumptive conditions can often receive disability benefits without having to produce detailed nexus opinions tying their illness to service.
